Dickinson Town Council Constitution

 

 

I.          Name & Purpose

 

A.            Name

 

The name of this organization shall be Dickinson Town Council (hereafter referred to as DTC or the Council).

 

B.            Purpose

 

1.            To define and ensure academic, social, and governing standards for all undergraduate Dickinson residents.

 

2.            To represent, advocate, and further the interest and welfare and to lead the students of Dickinson Community.

 

3.            To supervise and regulate the committees sponsored by the Council within the powers of this constitution.

 

II.            Dickinson Town Council

 

A.            Composition

 

1.            Membership Criteria

 

a.              All undergraduate students living in Dickinson Community are members of Dickinson Town Council.

 

b.                  All other residents of Dickinson Community (e.g. graduate students, Resident Directors) are members of Dickinson Town Council, except that they shall not be permitted to vote on any fiscal matter as determined by the DTC Parliamentarian, nor may they hold positions with guaranteed voting rights, as defined in Article II Section 3.b.

i.                     One Resident Director shall be appointed by the Assistant Director of Residential Life for Dickinson Community to be a liaison to DTC.

ii.                   The liaison may give reports at regular meetings of DTC if he or she deems it necessary.

 

c.                   The Assistant Director of Residential Life for Dickinson Community and the Faculty Master of Dickinson Community are members of Dickinson Town Council, except they shall not be permitted to vote on fiscal matters, general or special elections, or matters covered under Article I, Section B.2. as determined by the DTC Parliamentarian, nor may they hold any elected office as defined within this constitution and its bylaws. Both the Assistant Director and Faculty Master may give reports at regular meetings of DTC if either deems it necessary.

 

 

2.            Rights of Membership

 

            a.              Except as provided in Article II Section A.1:

 

                        i.            All members share equally in the rights of Dickinson Town Council and no rights shall be abridged.

 

                        ii.            All members may participate in the elections of DTC and no rights shall be abridged.

 

                        iii.            All members may participate in all events sponsored by DTC.

 

                        iv.            All members may participate in all events sponsored by organizations funded by DTC.

 

                        v.            All members may participate in the elections of any DTC sponsored organization to which they belong.

 

b.            Equality of rights shall not be denied or abridged by DTC on account of race, creed, religion, or sex.

 

3.            Determination of Voting Rights

 

                        a.            Any member with guaranteed voting rights, or who has established voting rights according to constitutional procedure, shall be entitled to one vote on all motions brought before the Council, except as provided in Article I Section A.1.b.

 

b.            Positions with Guaranteed Voting Rights

 

            i.            DTC President

 

ii.            Chief Financial Officer (CFO)

 

iii.            Secretary

 

iv.            Parliamentarian

 

v.            Academic Vice President

 

vi.            Social Vice President

 

vii.            Committee chairs or their appointed representatives (one per committee)

 

viii.            Floor representatives (one per floor)

 

c.            Positions without Guaranteed Voting Rights

 

i.            SASU Representative

 

ii.            Auxiliary Services Representative

 

iii.            Menu Committee Representative

 

iv.            HCC Representative

 

v.            Any other position not specifically listed in Article II Section A.3.b, “Positions with Guaranteed Voting Rights.”

 

d.            Establishment of Voting Rights

 

i.            Any member of Dickinson Town Council may obtain voting rights by attending three consecutive Council meetings.

 

ii.            A voting member of DTC without guaranteed voting rights will lose their vote if they are absent from three consecutive Council meetings.

 

e.            Limitations

 

                        i.            No member of DTC may have more than one vote, nor simultaneously serve in two positions with guaranteed voting rights or with the right to appoint a voting representative.  An executive board member who is required as part of their constitutional duties to serve as a committee chairperson shall not be serving in two separate positions.

 

                                                ii.            The chairperson at a Council meeting shall only vote in the case of a tie.

 

                                                iii.            No individual who is not a member of Dickinson Town Council, according to the criteria established in Article II Section A.1, shall be entitled to a vote at Council meetings.

 

3.            Persons required to attend

 

The following persons are required to attend Dickinson Town Council meetings.

 

a.            All residence hall presidents.

 

b.            Floor representatives.

 

c.            Committee heads or an appointed representative from each committee.  The Elections committee is exempt from this requirement when there is no Dickinson Town Council election currently in progress.

 

d.            Each member holding any of the auxiliary positions described in Article III.

 

e.            All members of the executive committee.

 

B.            Powers

 

                        1.         To distribute and utilize funds allocated by the Student Association or other campus organizations, or acquired through fundraising.

 

                        2.         To represent and take action on behalf of the students of Dickinson Community.

 

                        3.         To supervise and regulate the committees sponsored by Dickinson Town Council.

 

C.            Procedures

 

1.            Meetings

 

Dickinson Town Council meetings shall be run according to Robert's Rules of Order insofar as these rules do not conflict with this constitution or its bylaws.

 

a.            Regular Meetings

 

i.            DTC meetings shall be held once a week at a day and time determined by the Council.

 

ii.            The last regular meeting of the semester shall be held no later than the Sunday before finals week.

 

b.            Special Meetings

 

i.            A special meeting is any meeting of the full Council other than a regular meeting.

 

ii.            Any special meeting of Dickinson Town Council must be announced at least 24 hours in advance.

 

iii.            The President may call a special meeting of the Council.

 

iv.            Any Council member may move that a special meeting be held.  The motion is debatable and requires a simple majority to pass.

 

c.            Quorum

 

                        i.            In order for any business to be conducted, either the DTC President or the Secretary must be present at a Council meeting.

 

ii.            In order for any business to be conducted, a quorum of four out of the six residence halls must be present at a Council meeting.

 

iii.            A hall is considered present at a Council meeting if at least four floor representatives from that hall are present at the meeting.

 

d.            New Business

 

i.            No item of new business shall be voted on prior to the meeting following the one in which it is presented.  This requirement may be suspended by a 2/3 vote of the Council.

 

ii.            Any main motion shall be considered new business at the meeting during which it is first presented.

 

III.            Auxiliary Positions

 

A.            Composition and Function

 

1.            Harpur College Council (HCC) Representative

 

                        a.            Shall attend all HCC meetings.

 

                        b.            Shall represent the wishes and interests of Dickinson Community students at HCC meetings to his or her best ability.

 

                        c.            Shall report to and solicit input from the Council.

 

                        d.            Shall be the Academic Vice President of DTC or his or her designate.

 

2.            Auxiliary Services Representative

 

                        a.            Shall serve as Dickinson Community student representative on Binghamton University Auxiliary Services committees to the best of his or her ability.

 

            b.            Shall report to and solicit input from the Council.

 

            c.            Shall be elected for one academic year by the members of DTC.

 

3.            Student Association of the State University (SASU) Representative

 

            a.            Shall attend all SASU meetings.

 

                        b.            Shall represent the wishes and interests of Dickinson Community students to SASU to his or her best ability.

 

            c.            Shall report to and solicit input from the Council.

 

            d.            Shall be elected for one academic year by the members of DTC.

 

            4.            Menu Committee Representative

 

                                                                        a.         Shall arrange an appropriate day and time for Menu Committee meetings.

 

                                                                        b.         Shall attend all menu committee meetings or find a suitable replacement.

 

                                                                        c.         Shall solicit representatives from each residence hall to serve on the Menu Committee.

 

                                                                        d.         Shall ensure that dining hall management follows up on requests and/or concerns raised by the Menu Committee.

 

                                                                        e.         Shall report to and solicit input from the Council.

 

                                                                        f.          Shall be the Auxiliary Services Representative or his or her appointed designate.

 

                                                                        g.         Shall assume the responsibilities of the Auxiliary Services Representative if a vacancy exists until elections are held.

 

IV.            Committees of DTC

 

A.            General

 

            1.            Powers and Responsibilities

 

                                                a.         Committees shall have the authority to utilize funds allocated by Dickinson Town Council or acquired through fundraising in accordance with DTC Financial Procedures.

 

                        b.            Responsibilities of the Chairperson

 

                                                                        i.          Except where otherwise specified in this Constitution, the chairperson shall maintain financial records for the committee.  He/she shall have the authority to delegate this responsibility.

 

                                                                        ii.          Shall oversee but shall not have the authority to dictate actions of the committee.

 

                                                                        iii.         Shall ensure that the committee fulfills its responsibilities under this constitution and its bylaws, and in accordance with the explicit wishes of the Council.

 

                                                                        iv.         Shall represent the committee and report on its activities to the Council.

 

            2.            Limitations

           

                                                a.         No committee shall establish a charter or procedures or engage in activity which conflicts with provisions in this constitution or its bylaws.

 

                                                b.         No committee chairperson shall be elected or chosen who is not a member of DTC.

 

B.            Composition and Function

 

1.            Academic Committee

 

                        a.            Shall be comprised of the Academic Vice President of DTC and the Academic Vice Presidents of each Dickinson Community residence hall.

 

                        b.            Shall maintain the Dickinson Academic Center, and make it available for use by members of DTC.

 

                        c.            Shall govern use of the Dickinson Academic Center.

 

                        d.            Shall coordinate academic programs within Dickinson Community.

 

                        e.            The chairperson of the Academic Committee shall be the Academic Vice President of DTC.

 

2.            Co-Recreational Committee

 

            a.            Shall be comprised of any interested members of DTC.

 

                        b.            Shall coordinate the Co-Rec program within Dickinson community. This shall include the following responsibilities:

 

                        i.            holding captains’ meetings;

 

                        ii.            developing team rosters;

 

                        iii.            creating a competition schedule;

 

                        iv.            ensuring that games are properly refereed;

 

                                                v.            ensuring that the Co-Rec field is suitable for use prior to each game.

 

                        c.            The chairperson of the Co-Recreational Committee shall be elected for one academic year by the members of DTC. 

 

                                                i.            The Co-Rec chairperson shall act as a liaison between the Council and appropriate recreational authorities at Binghamton University.

 

                                                ii.            The Co-Rec chairperson shall, in conjunction with representatives from other Binghamton University colleges, coordinate an intercollegiate Co-Rec playoff.

 

                                                iii.            Two people may hold the position of Co-Rec chairperson jointly, but only one shall have guaranteed voting rights at Council meetings.

 

3.            Darkroom Committee

 

                        a.            Shall be comprised of any interested members of DTC.

 

                        b.            Shall maintain the Dickinson Darkroom, and make it available for use by members of DTC.

 

                        c.            Shall govern use of the Dickinson Darkroom.

 

                        d.            The chairperson of the Darkroom Committee shall be elected for one academic year by the members of DTC.

 

4.            Dickinson Community Players

 

                        a.            Shall be comprised at least of any interested members of DTC.

 

                        b.            Shall conduct one or more theatrical productions per semester which are open to all Dickinson residents.

 

                        c.            Shall be permitted to charge a reasonable entry fee for their productions, if that fee is necessary in order to cover operating costs and equipment upgrades.

 

                        d.            The chairperson of DC Players shall be chosen by the members of DC Players according to procedures outlined in the DC Players charter. 

 

5.            DTC Newsletter

 

                        a.            Shall be comprised of any interested members of DTC.

 

                        b.            Shall publish DTC minutes and announcements and other items of interest to the community.

 

                        c.            The chairperson of the DTC Newsletter shall be the editor, who shall be elected for one academic year by the members of DTC.

 

6.            Elections Committee

 

                        a.            The composition, powers, and responsibilities of the Elections Committee shall be as defined in Article IX, Election Procedures.

 

                        b.            The chairperson of the Elections Committee shall be elected for one academic year by the members of DTC.

 

            7.            Equipment Committee

 

                        a.            Shall be comprised of any interested members of DTC.

 

                                                b.         Shall maintain equipment owned by Dickinson Town Council that does not fall under committee jurisdiction.

 

                                                c.         Shall make that equipment available for use by DTC members, and govern its use.

 

                                                d.         Shall be permitted to charge a reasonable fee for the use of that equipment.

 

                        e.            The chairperson of the Equipment Committee shall be elected for one academic year by the members of DTC.

 

8.            Finance Committee

 

                                                a.         The composition, powers, and responsibilities of the Finance Committee shall be as defined in Article IX, Financial Procedures.

 

                                                b.         The chairperson of the Finance Committee shall be the Chief Financial Officer of DTC.

 

9.            Mutant Mania Committee

 

            a.            Shall be comprised of any interested members of DTC.

 

b.                  Shall be responsible for organizing and running Mutant Mania, a Dickinson-wide event which takes place during the Spring Semester of each year.

 

i.  Mutant Mania shall end no later then 3 weeks before the start of          

    finals.

 

                        c.            The chairperson of the Mutant Mania Committee shall be elected for one academic year by the members of DTC.

 

10.            Presidents Committee

 

                        a.            Shall be comprised of the President of DTC and the presidents of each Dickinson Community residence hall.

 

                        b.            Shall consider matters affecting Dickinson Community as a whole and report findings or recommendations to the Residence Hall Councils and to DTC.

           

                        c.            Shall meet at least monthly to ensure communication amongst the Residence Hall Councils.

 

                        d.            The chairperson of the Presidents Committee shall be the President of DTC.

 

11.            Pseudopod Committee

 

                        a.            Shall be comprised of all members of the Computers, Robotics, and Engineering Special Interest Housing Module (CoRE).

 

                        b.            Shall administer and establish policy for the Pseudopod, a computer facility located in O’Connor Hall.

 

                        c.             Shall improve the equipment and general condition of the Pseudopod in order to provide Dickinson Community with the best possible computing services.

 

                        d.            The chairperson of the Pseudopod committee shall be chosen according the CoRE Lifestyle Agreement filed with the Office of Residential Life.

 

12.            Resident Hall Councils

 

                        a.            Each Dickinson Community residence hall shall be represented by a Residence Hall Council.  Membership in this council shall be open to all residents of the hall.           

 

                        b.            Residence Hall Councils shall be responsible for ensuring attendance at DTC by floor representatives.

 

                        c.            Residence Hall Councils shall be responsible for ensuring proper selection of floor representatives, as described in Article V.

 

                        d.            Each residence hall council shall be led by an Executive Board, including at least the following positions.  The Hall Executive Board members shall be elected for one academic year by the residents of the hall according to Article VIII, Election Procedures.

 

                                    i.            President

 

                                    ii.              Secretary

 

                                    iii.             Treasurer

 

                                    iv.            Social Vice President

 

v.                   Academic Vice President

 

vi.             Student Association Representative

 

                        e.            Each residence hall council shall be considered separately a committee of DTC.

 

                        f.            The presidents of the residence halls shall be the chairpersons of their respective councils.

 

13.            RA Council

 

                        a.            Shall be comprised of all Dickinson Community Resident Assistants (RAs).

 

                        b.            Shall coordinate RA programming within Dickinson Community, and shall sponsor community-wide events designed to promote community spirit.

 

            c.            Shall meet at least monthly.

 

                        d.             The chairperson of RA Council shall be elected by the members of RA Council.

 

14.            The Rime Cellar

 

            a.            Shall be comprised at least of any interested members of DTC.

 

                        b.            Shall administer and establish policy for the Rime Cellar, a coffee house located in the basement of Digman Hall.

 

            c.            Shall provide a forum for student and community performers.

 

                        d.            The chairperson of the Rime Cellar shall be elected by the members of DTC.

 

15.            Social Committee

 

                        a.            Shall be comprised of the Social Vice President of DTC and the Social Vice Presidents of each Dickinson Community residence hall.

 

                        b.            Shall coordinate social programs within Dickinson Community and between Dickinson and other Binghamton University residential communities.

 

                        c.            The chairperson of the Social Committee shall be the Social Vice President of DTC.

 

16.            Special Interest Housing Committee

 

                        a.            Shall be comprised of one representative from each Dickinson Community Special Interest Housing Module.

 

                        b.            Shall provide social and educational programming to Dickinson Community residents appropriate to the modules’ purposes and guidelines.

 

                        c.            The chairperson of the Special Interest Housing Committee shall be elected by the members of the committee.

 

17.            Yearbook Committee

 

                        a.            Shall be comprised of any interested members of DTC.

 

                        b.            Shall publish a Dickinson Yearbook in the spring of each academic year.

 

                        c.            Shall be permitted to charge a reasonable fee for purchase of a Yearbook, if that fee is necessary to cover the cost of producing the Yearbook.

 

c.                   The chairperson of the Yearbook Committee shall be the Yearbook editor, who shall be elected for one academic year by the members of DTC.

 

18.              Semi-Formal Committee

 

a.                   Shall be comprised of the Social Vice President of DTC, the Social Vice Presidents of each Dickinson Community Residence Hall, and any interested members of DTC.

 

b.                  Shall arrange for and coordinate the Dickinson Community Annual Semi-Formal.

 

c.                   Shall publicize and sell tickets for the Dickinson Community Semi-Formal.

 

d.                  The chairperson of the Semi-Formal Committee shall be the Social Vice President or his/her designee.

 

C.            Ad Hoc Committees

 

                        1.         Ad Hoc committees may be formed by the DTC President or by the Council.

 

                                                a.         If an Ad Hoc committee is formed by the DTC President, it shall only have the authority to issue recommendations to the President or the Council.

 

                                                b.         If an Ad Hoc Committee is formed by the Council, its powers shall be defined by the Council, and shall not extend beyond the powers of the Council acting alone.

 

                        2.         The chairperson of an Ad Hoc Committee shall not be guaranteed a vote at Council meetings.

 

 

E.            Election of Committee Chairpersons

 

            In all cases where a committee chairperson is elected by the full membership of DTC, this election shall be conducted according to procedures described in Article VIII, Elections Procedures.

 

V.        Floor Representatives

 

                        A.        Each floor in each Dickinson Community residence hall shall have one floor representative.

 

                        B.         Responsibilities

 

                                                1.         Shall attend all DTC meetings or appoint a substitute to take his/her place.

 

                                                2.         Shall represent the wishes and interests of the residents of their floor to the best of their abilities.

 

                                                3.         Shall report to and solicit input from the residents of their floor.

                                   

C.            Floor representatives shall be chosen by the residents of their floors.

 

D.        Resident Assistants shall not be required to serve as floor representatives.

 

VI.       The Executive Committee

 

A.            Composition

 

1.            The Executive Committee shall consist of the Dickinson Town Council President, Chief Financial Officer, Parliamentarian, Secretary, Academic Vice President, and Social Vice President.

 

2.            All members of the executive committee must be undergraduate members of Dickinson Town Council.

 

B.            Powers

 

            1.            Shall arrange and coordinate meetings of Dickinson Town Council;

 

            2.            Shall act in place of the Council during emergencies. 

 

                                                a.         In order for the Executive Board to exercise emergency power, all of the following conditions must be true:

 

                                                                        i.          An issue must be before Board which has a critical impact on the Council or Dickinson Community as a whole;

 

                                                                        ii.          This same issue must be sufficiently time-sensitive that it cannot resolved satisfactorily if postponed until an regular or special Council meeting can be held;

 

                                                                        iii.         At least four Executive Board members must be present;

 

                                                                        iv.         All Executive Board members who are present must agree that the issue before the Board meets the criteria listed above.

 

C.            Duties

 

1.            President

 

                        a.            Shall be elected for one academic year by the members of DTC.

 

                        b.            Shall coordinate DTC programs in accordance with the wishes of the Council, and shall encourage the formation of new programs.

 

                        c.            Shall work to foster community spirit.

 

                        d.            Shall mediate disputes related to Council business, but shall not have the authority to arbitrate.

 

                        e.            Shall act as general liaison between Dickinson Community and the other residential colleges, the Student Association, and the University at large.

 

                        f.            Shall have the authority to appoint ad hoc committees, as described in Article IV Section C.

                       

                        g.            Shall have the authority to call special Council meetings, as described in Article III Section C.1.b.

 

                        h.            Shall chair the Presidents Committee.

 

                        i.            Shall chair Dickinson Town Council, except as otherwise specified in this Constitution.

 

2.            Chief Financial Officer

 

a.            Shall be elected for one academic year by the members of DTC.

 

b.            Shall oversee all financial dealings within Dickinson Community pertaining to Dickinson Town Council funds in accordance with the wishes of the Council.

 

c.            Shall act as financial liaison between DTC and the Student Association.

 

d.            Shall chair the finance committee and be responsible for reporting the recommendations of the finance committee to the council.

 

e.            Shall maintain and distribute the document “Dickinson Town Council Financial Guidelines” to all treasurers and committee heads and shall ensure that committees sponsored by the Council adhere to these guidelines.

 

i.            “Dickinson Town Council Financial Guidelines” must be updated as necessary to conform to the financial policies of the Student Association.

 

ii.            “Dickinson Town Council Financial Guidelines” must not conflict with either the DTC Constitution or its bylaws or with the Student Association constitution or financial policies.

 

f.            Shall have the power to appoint, if he or she deems it necessary, an assistant CFO.

 

                        i.            If the position of CFO is vacant, the assistant CFO, if he/she has been appointed, shall assume the position of acting CFO until elections are help according to constitutional procedures.

 

g.            Shall have the authority to establish sub-accounts of the Dickinson Town Council budget, according to procedures described in Article IX, Financial Procedures.

 

3.            Secretary

 

            a.            Shall be elected for one academic year by the members of DTC.

 

                        b.            Shall record all business which takes place at Council meetings, and shall make this record available to all members who request it.

 

            c.            Shall keep weekly records of attendance at DTC meetings.

 

            d.            Shall publicize DTC meetings and community-wide events.

 

                        e.            Shall maintain a current calendar of community events, and provide this calendar to the DTC Newsletter for publication.

 

                        f.            Shall draft correspondence at the request of the Council or the Executive Committee.

 

                        g.            Shall chair Dickinson Town Council in the absence of the constitutionally-designated chairperson.

 

4.            Parliamentarian

 

            a.            Shall be elected for one academic year by the members of DTC.

 

                        b.            Shall advise council on matters of constitutional or parliamentary procedure.

 

            c.            Shall record all amendments to this constitution or its bylaws.

 

                        d.            Shall assist DTC committees who are writing or modifying their charters to maintain consistency with this Constitution and its bylaws.

 

                        e.            Shall periodically review this Constitution and its bylaws, and propose modifications which would improve its effectiveness.

 

            f.            Shall chair the DTC Judicial Board.

 

                        g.            Shall chair the DTC Budget Meeting, as described in Article IX, Financial Procedures.

 

5.            Academic Vice President

 

            a.            Shall be elected for one academic year by the members of DTC.

 

            b.            Shall chair the Academic Committee.

 

                        c.            Shall act as academic liaison between Dickinson Community and the other residential colleges, the Student Association, and the University at large.

 

                        d.            Shall act as Harpur College Council Representative or appoint a council member to do so.

 

6.            Social Vice President

 

                        a.            Shall be elected for one academic year by the members of DTC

 

                        b.            Shall chair the Social Committee.

 

                        c.            Shall act as social liaison between Dickinson Community and the other residential colleges, the Student Association, and the University at large.

           

 

VII.     The Judicial Board

 

A.            Composition

 

            1.            The Judicial Board shall be comprised of seven members, who shall be:

 

                                                a.         two floor representatives, each of whom may be from any Dickinson residence hall;

 

                                                b.         two committee chairpersons;

 

                                                c.         two Hall Secretaries, each of whom may be from any Dickinson residence hall;

 

                                                d.         the Parliamentarian of DTC.

 

                        2.         The floor representatives, committee chairpersons, and Hall Secretaries who comprise the membership of the Judicial Board shall be elected.  These votes may not be conducted in secret or by secret ballot.

 

                                                a.         The floor representatives shall be elected by the floor representatives at large.

 

                                                b.         The committee chairpersons shall be elected by the committee chairpersons at large.

 

                                                c.         The Hall Secretaries shall be elected by the Presidents Committee.

 

                        3.         Judicial board members shall be chosen at the beginning of each academic year, and shall serve for one academic year.  Special elections may be held, according to the procedure outlined in Article VIII Section A.2, in order to replace Judicial Board members who resign, or who are removed according to constitutional procedure, or who no longer hold the position on the basis of which they were elected to the Judicial Board.

 

                        4.         No member of the DTC Executive Board, nor a Hall President, may be a member of the Judicial Board, excepting the DTC Parliamentarian.

 

                        5.         Any member of the Judicial Board may decline to participate in Judicial Board proceedings if he/she feels unable to be fair and impartial with respect to the issue under consideration.

                       

                        6.         The chairperson of the Judicial Board shall be the Parliamentarian, who shall vote only in the case of a tie.

 

B.            Powers

 

                        1.         Shall have the authority to resolve disputes which are referred to it by the Council according to procedures described in Article VII Section C, and within the powers of DTC.

 

C.            Procedures

 

                        1.         A simple majority vote of the Council shall be required to refer an issue to the Judicial Board.

 

                        2.         Judicial Board proceedings shall be conducted according to Robert’s Rules of Order, except that a 2/3 vote of the Judicial Board shall be required to resolve action on any referred issue.

 

                        3.         Proceedings of the Judicial Board shall never be conducted in secret, except as follows:

 

                                                a.         If a witness is called to testify before the Judicial Board, that witness shall be permitted to make his or her statement in private, and that statement shall not become a part of the public record, if this action is approved by a 2/3 vote of the Judicial Board.

 

                                                b.         A vote may be taken in private, and the votes of individual Judicial Board members shall not become a part of the public record, if this action is approved by a 2/3 vote of the Judicial Board.

 

                        3.         The Judicial Board shall report its resolution at a Council meeting within 11 class days of a referral.

 

                        4.         The Council shall have the right to overturn decisions of the Judicial Board by a 2/3 vote.  This vote will not be valid unless conducted within 11 class days of the Judicial Board’s report at a Council meeting.

 

VIII.            Dining Hall Closings

 

Dining Hall Closings shall be conducted according to the bylaw entitled "Dickinson Town Council Procedures for closing the Dickinson Dining Hall.

 

IX.           Election Procedures

 

Election procedures shall be conducted according to the bylaw entitled “Dickinson Town Council Election Procedures.”

 

X.            Financial Procedures

 

Financial procedures shall be conducted according to the bylaw entitled “Dickinson Town Council Financial Procedures.”

 

XI.            Removal of Officers

 

                        A.        Any member of the Executive Board, or of the Judicial Board, or any Committee Chairperson who is elected by the full membership of DTC, shall be considered an officer of DTC for the purposes of this article.

 

                        B.         Removal of an officer shall require a 2/3 vote of the members of DTC.  This vote shall be conducted according to procedures described in Article VIII, Election Procedures.

 

                        C.        Whenever a petition, signed by fifty percent (50%) of the dorm council is filed with the Elections Committee, requesting that an election be called to vote upon the recall of a member, a recall election will be held within ten (10) days of filing the said petition.  If the majority vote of that recall election is affirmative, that seat will be considered vacant.

 

XII.            Enforcement

 

            Ultimate power to enforce this Constitution shall rest with Dickinson Town Council.  No other organization or entity shall claim jurisdiction over Dickinson Town Council or its  committees or its activities, except as explicitly permitted within this Constitution, or required by the constitution or bylaws of the Binghamton University Student Association, or required by local, state, or federal law.

 

XIII.            Amending the Constitution or its Bylaws

 

A.            This document may be amended by a 2/3 vote of the Council.

 

B.         A bylaw to this constitution may be enacted, or an existing bylaw amended, by a 2/3 vote of the Council.

 

XIV.            Ratification

 

                        A.        This Constitution shall become effective immediately following its ratification by DTC, and shall supersede any previous constitutions, bylaws, and procedures, except as follows:

 

                                                1.         Article IX, “Election Procedures” shall not become effective until the bylaw entitled “Dickinson Town Council Election Procedures” has been ratified according to Constitutional procedures.  Until such time, Article VIII Sections A, D, E, and Article XI the DTC Constitution dated 9/20/92 shall be considered valid.

 

                                                2.         Article X, “Financial Procedures” shall not become effective until the bylaw entitled “Dickinson Town Council Financial Procedures” has been ratified according to Constitutional procedures.  Until such time, funds shall not be allocated except by a majority vote of Council.  Funds shall be utilized in accordance with their purpose as designated by the Council, and in accordance with Student Association financial procedures.
